By visiting our site and/ or  purchasing any product  on the website, you engage in our “Service” and  also agree to be bound by the terms and conditions (“Terms of Service” or “ Terms”). The Terms  include  those additional terms and conditions referenced herein  or available by hyperlink stated herein. If these Terms are considered an offer, acceptance is expressly limited to these Terms. 
It is deemed that the you are an adult and eligible to contract as per the prevailing law. It is also deemed  that the  Terms are read, understood and agreed  by you before making the purchase.

 

We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website.  

Our on-line store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.

You agree that the purchases of  our services and products are subject to provisions stated in the Refund Policy, Privacy Policy, Disclaimer and Indemnification  appearing elsewhere in  this Terms  or published elsewhere on the  website. You are deemed to have read, understood and agree with the provisions stated therein.

 

You should  use our products for the intended purposes only. The orthopedic products are for personal use and should not be used by used by  multiple persons or  any person other than for  whom it was purchased to use.  

 

All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We reserve the right to refuse service or products altogether  to any person without assigning any reasons.   In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.  The products may have limited quantities and are subject to return or exchange only according to our Refund Policy

However, we are not responsible for any damages suffered by the user due to in accuracy or incompleteness of certain information. User pf our product is recommended to also refer professional medical advice for making decision to use the product. This site may also  contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only.  

Within the limitations of technology, we have tried our best   to display as accurately as possible the colors and images of our products that appear at the store. The actual color or image  may be at variance with what you have observed on your computer monitor.

Occasionally there may be information on our site or product catalogues that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments.  We take no responsibility and assume no liability for any comments posted by you or any third-party.

   

DISCLAIMER

 

Our orthopedic supports and memory foam cusions  are manufactured based on the most commonly adopted  designs. They are intended  to provide  comfort  and reduce pain, but they are not medical devices. They should be used as recommended and   may help the users to  manage pain and enhance comfort where the users are suffering from certain medical conditions mentioned in our product guide. Also the orthopedic products are for personal use and should not be used by  multiple persons or any  person  than for  whom it was purchased to use.   

 

However, our recommendations or the products  are not substitute for professional medical advice, diagnosis, or treatment. We strongly recommend to seek medical advice before using our products, especially if you have underlying medical conditions or concerns. In case the user feels that that a certain medical condition has aggravated due to the use of our products, the use of the same should be discontinued and medical advice should be sought.

 

You agree to indemnify us against any damages suffered by the user which may have  caused due to not using our products as recommended or  use against professional medical advice.

 

 

INDEMNIFICATION

 

You agree to indemnify, defend and hold harmless OAE and our employees,   agents and  suppliers  harmless from any claim or demand,   made by any third-party due to or arising out of your breach of these Terms  or your violation of any law or the rights of a third-party in regard to usage of our products or services,  or any modification of the product or services, price change, suspension or discontinuance of the Service by us. 

SEVERABILITY 

 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms , such determination shall not affect the validity and enforceability of any other remaining provisions

 

TERMINATION 

 

These Terms of Service shall remain  effective till terminated by either you or us or up to the date of expiry of warranty explicitly stated at the time purchase of the product or services  or one (1) year from the date of  purchase, whichever is earlier. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 
 
ENTIRE AGREEMENT 

 

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. 
These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of our services or products.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.
